Update: Enforcement of Medicare Protection Act provisions (Bill 92) delayed one year

March 14, 2019

The provincial government is again delaying enforcement of provisions of the Medicare Protection Act (Bill 92) that relate to extra billing and private MRI/diagnostic facilities (Section 18.1)

  • Enforcement of financial penalties for extra billing for medically necessary treatments was to originally begin October 1, 2018 but just as it was to take effect, was delayed to April 1, 2019.  Enforcement has now been delayed again - for one year until after March 31, 2020 - to be consistent with the court’s decision granting an injunction in a similar case.
  • Enforcement of a provision stating that private diagnostic facilities cannot charge patients has also been delayed - until April 1, 2020 -  to keep all amendments in alignment.
